This AUP is incorporated into and forms part of our Terms of Service. By using the Service, you agree to comply with this policy. Violation of this AUP may result in suspension or termination of your account.

1. Permitted Use

Desire AI is designed to help jewelry brands create marketing content using artificial intelligence. You may use the Service to:

Generate marketing copy, social media posts, email campaigns, product descriptions, and other promotional content for your jewelry brand or business.
Customize your brand voice and tone settings to align AI-generated content with your brand identity.
Analyze and optimize your marketing efforts using the tools and analytics provided within the Service.
Collaborate with team members who are authorized under your subscription plan.
Export and publish AI-generated content on your own platforms, including websites, social media accounts, email newsletters, and print materials.

2. Prohibited Content

You may not use the Service to create, generate, store, transmit, or distribute content that:

Is unlawful: violates any applicable local, state, national, or international law or regulation.
Is fraudulent or deceptive: contains false, misleading, or deceptive claims about products, services, pricing, or materials. This includes generating fake reviews, testimonials, or endorsements.
Infringes intellectual property: violates the copyright, trademark, trade secret, patent, or other intellectual property rights of any third party. You may not input copyrighted material you do not have the right to use or instruct the AI to replicate protected works.
Is defamatory or harassing: defames, threatens, harasses, bullies, or intimidates any individual or group.
Contains hate speech: promotes hatred, violence, or discrimination based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic.
Is sexually explicit: contains pornographic, obscene, or sexually explicit material.
Promotes illegal activity: encourages, facilitates, or provides instructions for illegal activities, including but not limited to drug use, weapons manufacturing, money laundering, or terrorism.
Contains malware: includes viruses, worms, trojans, ransomware, spyware, or other malicious code or software.
Violates privacy: contains personally identifiable information of individuals without their consent, or otherwise violates the privacy rights of any person.
Is spam: constitutes unsolicited commercial communications, chain letters, or mass messaging that violates applicable anti-spam laws (such as the CAN-SPAM Act).

3. Prohibited Activities

You may not engage in the following activities when using the Service:

Reverse engineering: reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, or underlying technology of the Service or its AI models.
Scraping and data extraction: use automated tools, bots, scrapers, or crawlers to extract data from the Service, or systematically download or copy content generated by the Service beyond your normal use.
Circumventing restrictions: attempt to bypass, disable, or circumvent any security features, access controls, usage limits, or rate limits of the Service.
Account sharing or resale: share your account credentials with unauthorized individuals, allow multiple users to access a single-user account, or resell, sublicense, or redistribute access to the Service without our written consent.
Competitive use: use the Service to develop, train, or improve a competing product or service, or to benchmark the Service against competing products without our prior written permission.
Impersonation: impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity when using the Service.
Interference with the Service: take any action that imposes an unreasonable or disproportionately large load on our infrastructure, interferes with the proper functioning of the Service, or disrupts other users' access to or use of the Service.
Automated abuse: use the Service through automated means (other than our official API, if available) in a manner that exceeds fair use or is designed to exploit the Service beyond its intended purpose.

4. AI-Specific Guidelines

Because Desire AI uses artificial intelligence to generate content, the following additional guidelines apply:

Human review required: you are responsible for reviewing all AI-generated content before publishing or distributing it. AI-generated content may contain errors, inaccuracies, or unsuitable material. You must verify that all content meets your standards and complies with applicable laws before use.
No misrepresentation of AI content: you should not present AI-generated content in a way that is likely to deceive consumers about the nature or origin of the content in contexts where such disclosure is required by law or regulation.
Compliance with advertising laws: all marketing content generated by the Service must comply with applicable advertising and consumer protection laws, including the Federal Trade Commission (FTC) guidelines on endorsements, testimonials, and truth in advertising. You are responsible for ensuring compliance.
No manipulation of AI outputs: you may not attempt to manipulate the AI to produce outputs that circumvent this AUP, including using prompt injection techniques or adversarial inputs designed to bypass content safety measures.

5. Usage Limits

Each subscription plan includes specific usage limits (such as the number of AI-generated outputs, team members, or connected accounts). You agree to use the Service within the limits of your plan. If you consistently exceed your plan limits, we may ask you to upgrade to a higher-tier plan. We reserve the right to throttle or temporarily restrict access if usage significantly exceeds plan limits.

6. Reporting Violations

If you become aware of any use of the Service that violates this Acceptable Use Policy, please report it to us at support@getdesireai.com. We take reports of abuse seriously and will investigate all credible reports.

7. Enforcement

We reserve the right to investigate potential violations of this AUP and take appropriate action, which may include:

Issuing a warning and requesting that you correct the violation.
Temporarily suspending your access to the Service while we investigate.
Removing or disabling access to content that violates this policy.
Permanently terminating your account without refund for serious or repeated violations.
Reporting illegal activity to the appropriate law enforcement authorities.

We will use reasonable judgment in enforcing this AUP and will endeavor to notify you before taking action (except where immediate action is necessary to protect the Service, our users, or third parties).

8. Changes to This Policy

We may update this Acceptable Use Policy from time to time. We will post the updated policy on this page with a revised "Last updated" date. Material changes will be communicated via email or a notice within the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated policy.
